Refund and Returns Policy

Our Warranty

At Safety Dave we stand behind every product that we sell. We warrant to You that the Safety Dave Product you have purchased is free from defects in workmanship and materials for the Warranty Period.

Fitting And Use

Please ensure that You:

a) Fit the Safety Dave Product in accordance with the Product Information and all relevant vehicle safety and compliance laws; and

b) Use the Safety Dave Product for the purpose for which it was originally designed and in accordance with the Product Information and all relevant vehicle safety and compliance laws.

Exclusions

Our warranty does not cover:

I. Normal wear and tear.

II. Fitting of the Safety Dave Product other than in accordance with the Product Information and all relevant vehicle safety and compliance laws, including incorrect fitting.

III. Using the Safety Dave Product other than for the purpose for which it was originally designed or other than in accordance with the Product Information and all relevant vehicle safety and compliance laws, including unusual, improper, or negligent use or misuse.

IV. Misuse or neglect of the Safety Dave Product, including improper repair or maintenance or failure to repair and maintain.

V. Alteration, abuse, acts of nature, terrorism, vandalism, collision, road hazards or adverse conditions.

VI. Formal or informal competitive events, such as racing, rallying, speed trials or similar activities; and

VII. Using the Safety Dave product in underground mining and other highly corrosive environments.

Making A Claim

Please immediately contact Us either by telephone or email as soon as You become aware of a possible defect in the Safety Dave Product, and:

I. We will do some initial troubleshooting with You over the telephone.

II. If the troubleshooting does not resolve the possible defect, we will ask you to send the Safety Dave product back to us (at your cost) for testing and assessment.

III. If our testing and assessment determines that the Safety Dave Product is functioning normally, we will send this back to you (at your cost).

IV. If Your claim is in order, we will notify You and (at Our sole discretion) repair or replace the defective workmanship or materials (at our cost) or refund to You the purchase price You paid for the defective Safety Dave product.

V. We will also request You to provide us with a Proof of Purchase and complete a Warranty Claim Form that We will send to You. Please note that We will not be able to accept Your warranty claim without a Proof of Purchase.

If further information or investigation is required or if the claim does not meet the requirements under Our Warranty Policy, we will let You know.

Please be aware that we have not authorized any Third Parties to manage warranty claims on our behalf. Any costs incurred by you without prior approval by the Our Warranty Manager will not be reimbursed by Us.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time.

If this is not done, you are entitled to a refund for the goods. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure with the goods.

Other Consumer Rights

The benefits to You under Our warranty are in addition to any other rights and remedies You are entitled to under relevant consumer laws. Our warranty replaces any other warranty given by Safety Dave or its supplier in respect of the Safety Dave Product.

Purchase Date

The date You purchased the Safety Dave Product either directly from Us or one of our commercial customers.

Warranty Period

The period commencing on and from the purchase date and ending as follows.

Proof Of Purchase

Purchase receipt from Safety Dave or proof of vehicle purchase with a Safety Dave kit included.

Warranty Claim Form

The Safety Dave claim form that we will send you via email, should you need to make a warranty claim.
